By accessing our website and/or placing an order, you are agreeing to comply with and be bound by the following terms and conditions of use, which together with our privacy policy govern our relationship with you in relation to this website. If you disagree with any part of these terms and conditions, please do not continue to use our website. If you have any questions regarding our terms, please contact us.

This site is operated by Sunset Cocktails Ltd whose registered address is 5 Tulip Close, Cotgrave, Nottingham, NG12 3SX and our registered company numbers is 12594775.

References to ‘we’, ‘us’ and ‘our’ refer to Sunset Cocktails Ltd. References to ‘you’ and ‘your’ refer to those using our site or placing an order via our site.

 

1.2 CONTRACT INFORMATION

These conditions of sale apply to products supplied by Sunset Cocktails Ltd. These terms and conditions do not affect your statutory rights.

By placing an order on our site, you are offering to purchase the products you have selected.

Accepting orders is at our discretion. If products are shown on the site but are sold improperly. Poorly described or not available, we will not be forced to sell these products.

Once you have placed your order we will send you email confirmation that we have received your order. This is not a confirmation that your offer to buy the products was accepted. A contract between you and Sunset Cocktails Ltd for the sale of our products will exist only once the order has been accepted, processed and shipped to you.

We reserve the right to change these general conditions of sale time to time without notice.

 

1.3 PRODUCT COMPLIANCE

We take every precaution to ensure that all descriptions and imagery of our products is correct. However, specifications, product descriptions and product images are only intended to give a general description of products and are not intended to be binding.

 

1.4 PAYMENT

Payment is made using our website and can be made by one of the options advertised. Once you place your order, your chosen card will be debited. Items will not be sent until payment is complete.

The cards are subject to validation checks and authorisation by your card issuer. If we do not receive the required authorisation, we will not be responsible for any delay or non-delivery. If the payment is not received, your order will be cancelled.

We do not store credit card details and we do not share customer details with third parties.

 

1.5 DELIVERY

We may require a signature upon delivery, so please ensure that someone is present to accept the delivery or leave instructions during the ordering process to know who else could sign for your delivery (i.e. a neighbour). Delivery drivers operate under the ‘Challenge 25’ scheme and therefore you may be requested to show photo ID to prove you are over 18. If you are under the age of 18 or you are unable to prove your age when requested, the product will be returned to Sunset Cocktails Ltd.

If delivery cannot be made to your address, you will be notified as soon as possible.

Orders placed before the specified time limit will be processed and delivered according to your request, provided security controls are not necessary and all products are available.

Every effort will be made to deliver your order according to your chosen delivery option. However, we will not be liable for any loss or damage suffered by you through reasonable or unavoidable delay in delivery. To avoid disappointment, we advise that you place your order in advance of the scheduled date. We will inform you of any delays as soon as possible.

If the package does not seem to be in good condition upon receipt of your order, then please refuse the delivery. If you are unable to check the contents of your delivery, then please sign for the parcel as ‘unchecked’. Not doing so can affect any claim you make thereafter.

Property of any item will not pass to you until we have delivered the item to you (either directly or by leaving it in a safe place or with a neighbour). Once confirmed as delivered, the risk of damage or loss of the object is passed to you.

 

1.6 CANCELLATIONS, RETURNS AND REFUNDS

 

1.6.1 YOUR RIGHT TO CANCEL

You have the right to cancel your order with us within 1 hour of your purchase. To cancel your order at this time, you must notify us by calling us.

If you want to cancel your order after the products have been delivered to you, you will be responsible for returning the goods to us at your own expense, unless the goods are defective. Please contact us to for information on how to return your product to us. You will be credited for the products within 30 days of receipt by us provided that the goods are returned complete, in perfect condition, unused and with original packaging.

 

1.6.2 RETURN POLICY

If you are not completely happy with the products you have chosen, you can return them within 10 days of receipt. We will be more than happy to offer you an exchange or, if you prefer, a refund provided that the products are returned complete, in perfect condition, unused and with original packaging. You will be responsible to return the goods to us at your own expense unless the goods are defective.

 

1.6.3 RETURN PROCEDURE

For all returns unless the item is defective or we shipped the wrong item, you will be required to pay for the return of products to us.

Before returning any product, please contact us to make us aware of your wish to return the product, to receive instructions on how to return the products to us and to confirm whether you want a refund or a replacement. We strongly recommend that you get a proof of shipment; we cannot accept responsibility for parcels lost in transit.

 

1.6.4 DEFECTIVE PRODUCT

In the unlikely event you receive a defective product, you must contact us in writing within 10 days of delivery. Goods must be returned in line with our returns instructions. Once we have received the property, we will check the fault. If the fault is verified, we will either:

  • Replace the product(s) like for like.

  • Provide a refund using the same payment method used for purchase in line with our refund policy.

If the goods you have returned are not found faulty, they will be returned at your expense.

 

1.6.5 ITEMS DAMAGED ON DELIVERY TO YOU

Our products are packed with extreme care and consideration. In the unlikely event that one of our products arrives damaged, we recommend you refuse delivery and contact us to explain the default. We will then arrange a replacement delivery as soon as possible.

If you accept delivery and wish to contact us about the damaged products, you will need to provide the following information within 48 hours of delivery:

  1. Photographic evidence of the broken product, making the quantity and the product itself clear

  2. Your order number

  3. Details product names and quantities broken

  4. Whether you want a replacement or refund

Once the fault is verified, we will either:

  • Replace the product(s) like for like.

  • Provide a refund using the same payment method used for purchase in line with our refund policy.

 

1.6.6 FALSE ITEM DELIVERED

If, by mistake, we provide you with the wrong item, you must notify us within 10 days. Goods must be returned in line with our returns instructions which you will receive by contacting us to request them. Once we have the received goods back, we confirm that is an inaccurate article and either:

  • Replace with the correct item.

  • Provide a refund using the same payment method used for purchase in line with our refund policy.

 

1.6.7 ADDITIONAL PRODUCTS DELIVERED

If, by mistake, we provide you with additional products you must inform us immediately. Goods must be returned in accordance with the return procedure, if you do not follow this procedure and are found in possession of property that you have not paid for, you will be charged for the goods.

 

1.6.8 REFUND POLICY

If you are eligible for a refund, we will refund the card used to pay for your initial order. Please note that it is your responsibility to inform us of any changes to your card i.e. changes to billing address. We aim get all eligible refunds processed within 7 business days of receipt of returned goods, although repayment may take up to 30 days in the busiest of times.

 

1.7 COUPONS, DISCOUNTS AND PROMOTIONAL CODES

Coupons, discounts and promotional codes offered by Sunset Cocktails Ltd are only valid for use in connection with a purchase via www.sunsetcocktails.co.uk unless otherwise stated. These promotional discounts are not valid for use on other websites. One coupon can be used per order. Coupons cannot be returned for cash or its equivalent.

Discounts awarded for registration are limited to one per customer (the email address and postal address must be unique). Any redemption found to be in breach of these requirements will result in the discount being removed from any secondary orders.

 

1.8 DISCLAIMER AND LIMITATIONS OF LIABILITY

To the maximum extent permitted by applicable law, we exclude all representations, warranties and conditions relating to our website and the use of this website. Nothing in this disclaimer will:

  • Limit or exclude our or your liability for death or personal injury.

  • Limit or exclude our or your liability for fraud or fraudulent misrepresentation.

  • Limit any of our or your liabilities in any way that is not permitted under applicable law.

  • Exclude any of our or your liabilities that may not be excluded under applicable law.

The limitations and prohibitions of liability set in this section and elsewhere the disclaimer are subject to the preceding paragraph and govern all liabilities arising under the disclaimer, including liabilities arising in contract, in tort and for breach of statutory duty.

As long as the website and the information and services provided on the website are free of charge, we will not be liable for any loss or damage of any nature.

1.11 LAW AND JURISDICTION

These conditions of sale and supply of goods shall be governed by English law and the English courts shall have jurisdiction over any dispute arising from the contract.

1.12 Great Taste Guarantee Terms and Conditions:

Sunset Cocktails Ltd are offering a money back taste guarantee to purchasers of Sunset Cocktails Espresso Martini 1 Litre bottle (“Qualifying Product”). The Guarantee is subject to the below terms and conditions.

  • The guarantee is open to purchases of a Qualifying Product who are residents of England aged 18 and over. 

  • The guarantee will be running from Tuesday 14th December 2021 until Monday 20th December 2021 at 10am. Only Qualifying Products purchased between these dates will be valid.

  • The guarantee entitles customers who have purchased a Qualifying Product to claim a refund of the purchase price of the product if they are not fully satisfied with the taste. To qualify, only 300ml or less of the product may be consumed and this Guarantee is available to only one Qualifying Product per household.

  • To apply for a full refund of the purchase price, please return the Qualifying Product bottle including all outer packaging (including at least 700ml) and the lid tightly secured, a copy of your purchase confirmation for the Qualifying Product (dated within the previous 30 days), your name and address, and a no greater than 15 word explanation of why you are not satisfied with the Qualifying Product.

  • Returns in the UK should be sent to Sunset Cocktails Ltd, 5 Tulip Close, Cotgrave, Nottingham, England, NG12 3SX within 30 days of purchase. Postage and delivery will be refunded for all Qualifying Products.

  • You will receive a refund to the account used to place the order, refunding the cost of the product as shown on the receipt and the postage and delivery of the returned product.

  • Please allow 14 days for the refund.

  • Proof of posting does not constitute proof of delivery.  No responsibility can be accepted by Sunset Cocktails for returns which have been lost, damaged, or delayed by post.  Defaced or illegible copies of purchase confirmation will deem the claim under the Guarantee invalid and will not be processed.

  • The Guarantee is offered by Sunset Cocktails Ltd.
